TERMS AND CONDITIONS OF USE FOR THE JUNGLE MEMBERSHIP

 

 

1. Acceptance of Terms

By registering and becoming part of the JUNGLE membership, the user (the "Member") expressly accepts these Terms and Conditions, as well as any future modifications that JUNGLE may make and communicate through official channels, including but not limited to the email address associated with the Member's account or a notice posted on the platform. Continued use of the platform after such notice constitutes acceptance of the modified terms.

2. Membership Description

JUNGLE is a platform that connects junior golf players with college coaches through a digital profile featuring statistics, tournament history, and performance videos. The membership includes:

  • Access to a personal player profile on the platform.

  • Participation in tournaments organized or endorsed by JUNGLE.

  • Direct connection with U.S. college coaches.

  • Data storage and performance analytics.

  • Global exposure opportunities through partners such as AJGA, WAGR, and Junior Golf Scoreboard.

Specific benefits vary by membership tier (Birdie, Eagle, Albatross) as described on the platform at the time of registration. JUNGLE reserves the right to modify tier benefits prospectively, with notice to affected Members before their next renewal.

3. No Guarantee of Outcomes

JUNGLE facilitates exposure and connects player data and profiles with college coaches and third-party platforms. JUNGLE does not guarantee scholarships, recruitment offers, tryouts, admission, or any specific athletic or academic outcome. Coach engagement, recruitment decisions, and scholarship awards are made solely at the discretion of third-party institutions, coaches, and organizations, and are entirely outside JUNGLE's control. Membership provides tools and exposure opportunities, not a guaranteed result.


4. Eligibility Requirements

The membership is intended for junior players between the ages of 11 and 18. Registration must be completed by a parent, legal guardian, or representative if the user is a minor. JUNGLE may require documentation confirming the identity and authority of the parent or legal guardian at any time.


5. Data Usage, Privacy, and Image Rights

By joining JUNGLE, the Member and, where applicable, their parent or legal guardian, authorize the use of their sports, personal, and image data for evaluation, promotion, statistics, coach connection, and dissemination on official JUNGLE channels and strategic partners, for the duration of the active membership.

Data may be shared with third parties only for purposes related to the platform's objectives (coaches, universities, federations, sponsors, and media).

This authorization may be revoked in writing at any time by contacting JUNGLE, without affecting content already published or shared prior to the revocation request. Revocation of image or data authorization may result in suspension of platform features that depend on that data (e.g., public profile, coach connection).

JUNGLE processes personal data in accordance with the Federal Law for the Protection of Personal Data Held by Private Parties (LFPDPPP), in force since March 21, 2025, and any applicable regulations issued by the Secretaría Anticorrupción y Buen Gobierno. Members and their legal guardians may exercise their rights of Access, Rectification, Cancellation, and Opposition (ARCO rights) by contacting JUNGLE through the channels indicated in its Privacy Notice ("Aviso de Privacidad").

Upon cancellation or deactivation of a membership, JUNGLE will retain personal data only for as long as necessary for legal, administrative, or legitimate business purposes, after which it will be deleted or anonymized, subject to applicable law.

For Members residing in the European Union, data processing is additionally governed by the General Data Protection Regulation (GDPR). Parental or guardian consent requirements for Members under the applicable local age threshold will follow the law of the Member's country of residence.


6. Tournament Participation

By registering for a tournament, the Member agrees that:

  • Their statistics will be collected to enhance their digital profile.

  • Photos, videos, and results may be used in JUNGLE's media.

  • Players must comply with each tournament's rules and youth conduct code.


7. Liability and Release

JUNGLE is not responsible for injuries, accidents, medical expenses, or losses occurring during tournaments or related activities. The Member or their legal representative releases JUNGLE, its organizers, partners, and affiliates from all liability.

To the maximum extent permitted by applicable law, JUNGLE's total liability arising from or related to the membership — including platform errors, service interruptions, or data inaccuracies — shall not exceed the total amount paid by the Member to JUNGLE in the twelve (12) months preceding the claim. This limitation does not apply to liability that cannot be limited or excluded under applicable law.


8. Third-Party Services and Data

JUNGLE integrates data and services from third-party providers, including but not limited to Junior Golf Hub (JGH), the Player Development Index (PDI), Upgame, Trackman, and AJGA. JUNGLE is not responsible for the accuracy, completeness, availability, or continuity of data or services provided by these third parties, and reserves the right to modify, suspend, or discontinue any integration at any time without liability to the Member.


9. Duration, Payments, and Renewals

  • The JUNGLE membership is valid for one (1) calendar year, i.e., twelve (12) months from the date of initial payment.

  • Upon expiration, the membership will automatically renew based on the payment plan selected at the time of registration (monthly, quarterly, semiannual, or annual), unless the Member requests cancellation before the renewal date by contacting JUNGLE through the channels indicated on the platform, at least 5 days prior to the renewal date.

  • The Member is responsible for keeping their billing information and payment method up to date. If automatic billing fails, JUNGLE reserves the right to temporarily suspend platform access until payment is regularized.

10. No Refunds

All membership payments — including initial membership registration fees, and tier upgrade fees (Birdie, Eagle, Albatross) — are final and non-refundable once processed. This applies regardless of the reason for cancellation, including non-use of the platform, dissatisfaction with services, early voluntary termination, or cancellation of a tournament in which the Member was registered. JUNGLE does not issue partial, prorated, or credit-based refunds for unused portions of a membership term.

This clause does not limit JUNGLE's ability to correct billing errors, duplicate charges, or unauthorized transactions, and does not override any non-waivable right the Member may have under applicable consumer protection law.


11. Membership Cancellation

JUNGLE reserves the right to cancel any membership if the user:

  • Provides false or incomplete information.

  • Violates internal rules or conduct codes.

  • Acts against the values and principles of the JUNGLE community.

Cancellation under this Section does not entitle the Member to any refund of payments already made (see Section 10).


12. Account Deactivation

Accounts with a membership expired for twelve (12) consecutive months will be automatically deactivated. Reactivation requires a new registration and is subject to the Terms and Conditions in effect at the time of reactivation.


13. Intellectual Property

All content created by JUNGLE (platform, tournaments, videos, analytics, logos, trademarks) is the exclusive property of the organization. Use without express written permission is prohibited.


14. Modifications

JUNGLE may modify these terms and conditions at any time. Changes will be communicated via the registered email or the platform.


15. Governing Law

This agreement is governed by the laws of Mexico. Any disputes will be resolved in the competent courts of Mexico City. For Members residing outside Mexico, this governing law provision applies to the extent permitted by the Member's local law; where local law grants non-waivable rights or jurisdiction to the Member, those rights are not affected by this clause.


16. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.


17. Entire Agreement

These Terms and Conditions, together with JUNGLE's Privacy Notice and any tournament-specific regulations, constitute the entire agreement between the Member and JUNGLE regarding the membership, and supersede any prior understandings on the subject.


18. Parental Consent

Since most users are minors, the parent or legal guardian declares that they have read, understood, and accepted these Terms and Conditions on behalf of the minor. They also authorize the use of the minor's data, image, videos, and other information as outlined in this document.
